Terms and conditions
This website complies with the Belgian Act of 6 April 2010 on market practices and consumer protection (Belgian Official Gazette 12.04.2010).
1. The online shop thiron.be is owned by Thiron Accessoires bvba, Sint-Antoniusstraat 2, 2000 Antwerp (Belgium). These general terms and conditions apply to all deliveries made and all services provided by Thiron Accessoires bvba, save for written exceptions and without prejudice to any special conditions agreed in a separate agreement. They take precedence over the customer's purchasing conditions. By placing an order, the customer agrees to these general terms and conditions of sale.
2. A sale is only concluded after written confirmation by the seller. Commencement of performance counts as confirmation, unless it was made subject to reservation.
3. Any cancellation of an order must be made in writing. It is only valid upon written acceptance by the seller. In the event of cancellation, a fixed compensation of 30% of the order price is due.
4. Delivery times are given for information purposes only and are therefore not binding unless expressly agreed. A delay in the execution of the order can never give rise to compensation or termination of the agreement.
5. Prices include Belgian VAT unless stated otherwise. The online shop thiron.be delivers to the countries listed below, with the respective shipping costs per order. The goods are delivered to the front door of the delivery address.
Any insurance costs are always borne by the customer, unless expressly agreed otherwise.
All prices stated on the website are valid while stocks last and provided that payment is made no later than upon delivery. The online shop thiron.be cannot be held liable for failure to deliver goods as a result of stock running out. We do, however, undertake to inform the customer in good time.
During promotions, the various discounts cannot be combined unless explicitly stated.
Consumers can pay for orders by credit card via the web. In the case of distance selling, the consumer may withdraw from the purchase within 14 days of delivery, without additional costs and without giving any specific reason. In that case, all advance payments will be refunded within 5 days, without interest. If delivery has already taken place, the customer shall return the goods by registered post at their own expense to Thiron, Sint-Antoniusstraat 2, 2000 Antwerp.
Traders must settle the invoice 15 days after the invoice date. In the event of late payment, all quantity discounts lapse and the full basic price becomes due.
6. The buyer must take delivery of and inspect the goods immediately. All goods can be returned, undamaged, within 14 days of delivery, as this concerns distance selling within the meaning of the Act of 6 April 2010 on market practices and consumer protection (Belgian Official Gazette 12.04.2010).
All shoes must be tried on a soft surface. The goods must be returned in their original packaging, and in the case of shoes in the original, undamaged shoe box. Shoes can only be returned if the plastic film applied to the sole has not been damaged or removed.
Complaints are only accepted if they are sent by registered letter within 14 days of delivery. A complaint does not suspend the obligation to pay.
7. The delivered goods remain the property of the seller until full payment of the sale price, plus any costs and interest. In the event of non-payment, the seller has the right to take back the goods without the intervention of a court.
8. The risk passes to the buyer at the moment the goods leave our warehouses.
9. The buyer shall notify the seller if the goods are stored in premises that the buyer rents. The buyer must inform the seller of the identity and address of the owner of the premises.
10. In the event of non-payment (in full) of an invoice on its due date, the invoice shall, by operation of law and without any notice of default being required, as provided for in the Act of 2 August 2002, be increased by the statutory interest rate plus 4% (with a minimum of 10%) per year. The invoice shall also be increased by a fixed damages clause of 10%, with a minimum of EUR 100, in addition to all costs incurred in collecting the invoice.
Any arrears in payment entitle us to postpone or cancel any order, including orders for which the goods have not yet been delivered, and also entitle us to take back goods that have already been delivered or are in transit. In the event of overdue payments, all invoices (whether due or not) become immediately payable.
11. In the event of a dispute, only the courts of Antwerp have jurisdiction, and where the Justice of the Peace has jurisdiction, the Justice of the Peace Court of the fifth district of Antwerp. Belgian law always applies.
